This study compares the three constitutional documents that were the subject of debate in Kenya's constitutional reform process in 2005. The authors have selected salient issues that have been persistenly contentious throughout the process. In some cases it is relevant to draw historical lines back to the independence constitution. These issues include:

  • Devolution
  • The Judiciary
  • Electoral system
  • Bill of rights
  • Land and property
  • Minority rights
